Tuesday.
Before his Honor, Acting Judge Wade.

    The legal profession was represented by Messrs Murray (Crown Prosecutor) Phillips, Garden, and Mason.
    Mr HW Shuttleworth, Deputy Sheriff, occupied a seat on the bench.
    Messrs Jas Smith and Duncan McInnes were excused from service on the jury on account of absence from the colony.

BEASTIALITY. [sic]

    Joseph Hannaby [aka Joseph Amby; Joseph Anaby] pleaded not guilty to a charge of beastiality.
    Mr Murray prosecuted, and the prisoner was undefended.
    Jury: WM Palmer, Jas Cass, TJ Byrnes, A Chambers, G Wilson, jun, H Mawby (Foreman), E Henry, J Bryant, P O’Brien, jun, W Maher, T Braithwaite, and H Hart.

    The evidence was of a revolting nature. John Maranda deposed he saw the offence committed on January 11th, and Constable Meagher deposed the accused admitted his guilt when he arrested him. The prisoner did not offer any defence.

    After a few minutes consideration the jury returned a verdict of guilty, and the prisoner was remanded for sentence.

SENTENCES.


    Joseph Hannaby, who had been found guilty of beastiality, was sentenced to five years penal servitude. His Honor stated that was the lowest penalty he could inflict, but owing to the prisoner being evidently of weak intellect he would give him the right to petition at the end of 18 months.
